Terms of service for bun.ink

1. Service description

bun.ink is a software-as-a-service platform for creating, editing, organizing and versioning text documents. In particular, the platform enables optional synchronization of documents with the user's GitHub repositories.

2. Conclusion of contract and contract language

By submitting the registration or ordering a paid subscription, the user makes a binding offer to enter into a contract. The contract is concluded upon confirmation by the operator, at the latest upon provision of the service.

The contract text is not stored separately by the operator and is no longer accessible via the website after conclusion of the contract. The terms of use applicable at any given time can be viewed, saved and printed on this page at any time.

The contract language is German and English. In the event of discrepancies between the German and the English version, the German version shall prevail.

3. User account

Certain features require the creation of a user account. The user is responsible for keeping their access credentials confidential.

4. Minimum age and legal capacity

Use of bun.ink requires that the user has reached the age of 18 and has full legal capacity. Minors may use the service only with the consent of their legal guardians.

5. Paid subscriptions

The use of certain bun.ink features may require a paid subscription. Subscriptions may be purchased monthly or annually.

All prices are final prices. Pursuant to Section 19 of the German VAT Act, no VAT is shown.

6. Payment processing and subscription management

Payment processing is handled through Stripe.

Subscription management, including cancellations, payment information and invoice data, is handled through the customer platform provided by Stripe.

Cancellations take effect at the end of the billing period already paid for.

7. Automatic renewal

Unless cancelled, a subscription renews automatically for the selected term.

8. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Withdrawal instructions

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the contract is concluded.

To exercise your right of withdrawal, you must inform us (bun.ink, email: info@visionx.dev) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

Early expiry of the right of withdrawal

Your right of withdrawal expires early if we have fully performed the service and only began performance after you gave your express consent and at the same time confirmed your knowledge that you would lose your right of withdrawal upon full performance of the contract by us. If performance begins, at your express request, before the end of the withdrawal period and you subsequently withdraw, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point of withdrawal.

9. GitHub integration and synchronization

Synchronization with GitHub occurs solely upon explicit user action.

Users are responsible for verifying that synchronization operations have completed successfully.

bun.ink makes no warranty regarding the availability, accessibility, or functionality of GitHub or other third-party services.

Technical failures, API changes, service outages, or restrictions imposed by GitHub may result in failed or incomplete synchronization processes.

The use of GitHub does not replace the user's responsibility to maintain independent backups of their content.

10. Ownership of content

All rights to content created by the user remain with the user. The user grants bun.ink only the usage rights required for technical operation.

11. Indemnification against third-party claims

The user shall indemnify the operator against all third-party claims asserted on the basis of content uploaded, stored or processed by the user via bun.ink. This also includes the reasonable costs of the necessary legal defense. The user shall support the operator in defending against such claims. The indemnification does not apply insofar as the user is not responsible for the infringement.

12. Storage and backups

Documents are stored in the databases used by bun.ink. Daily backups are created.

Backups do not establish a claim to restoration of individual data or complete data availability. The user remains responsible for maintaining their own backups.

13. Availability

Uninterrupted availability, freedom from errors or permanent reachability is not owed.

14. Prohibited content

Prohibited content includes in particular unlawful content, copyright infringements, spam, malware, harmful software and unlawful processing of third-party personal data.

15. Liability

The operator is fully liable in cases of intent and gross negligence. In cases of simple negligence, the operator is liable only for breaches of material contractual obligations and only up to the foreseeable damage.

16. Discontinuation of the service

The operator is entitled to discontinue bun.ink permanently or temporarily. Where possible, advance notice will be given. Users will be given an opportunity to export their data. Subscription periods already paid for but not yet used will be refunded pro rata.

17. Cancellation and account deletion

Users may cancel their account at any time. Before deletion, users have the opportunity to export their content. After account deletion, stored data may be permanently deleted.

18. Changes to the terms of use and prices

The operator is entitled to change these terms of use as well as the prices for paid subscriptions with effect for the future, provided this is necessary for objective reasons, such as a change in the legal situation, technical developments or changed cost structures.

Changes will be communicated to the user in text form (e.g. by email) at least six weeks before they take effect. If the user does not object within six weeks of receiving the notification, the changes are deemed accepted. The operator will specifically point out this consequence in the notification.

In the event of an objection, either party is entitled to terminate the contract at the time the changes take effect. Amounts already paid in advance for unused periods will be refunded pro rata.

19. Beta status

bun.ink is currently provided as a beta service.

Certain features may be incomplete, contain defects, or be modified, restricted, or removed at any time.

No warranty is provided that all features will be available at all times or operate without errors.

Users acknowledge that the platform is under active development and that features, user interfaces, and technical implementations may change without prior notice.

20. Consumer dispute resolution

The operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

21. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
